The owners of the eastern property covered by Easement 2, Tom Fijal and Desiree Kleemann, note that this property is subject to the Whatcom County Critical Areas Ordinance. Information about the requirements of this ordinance can be found here. The following is a partial list of the major requirements of the ordinance:
- A permit is required for any vegetation cutting, and this permit must be signed by the property owners.
- An environmental survey by a county-approved environmental consultant is required to support the permit application. Since this area is a designated critical area for slope stability and a protected wildlife corridor, reports for both areas are needed. The association had surveys completed for both topics in 2017; please contact one of the association officers for copies. A consultant who is qualified for both subjects and who has come to Point Roberts is Jeff Ninnemann at Canyon Environmental Group.
- There are limitations on the amount of vegetation that can be cut and how often such work can be done.
- Work must be supervised by a qualified arborist.
In addition, members should be aware of the provisions of the Washington State Timber Trespass Statute.
